Hello,

I hope I am doing this correctly, apologies if I have sent this enquiry to the wrong place.

I would like to know about the GIMP copyright and where it stands with using GIMP on-screen in film and television? Would this be allowed? Could you see a character editing an image on a computer using GIMP? If you need permission from someone for this, who should be contacted?

My understanding of the license of the Gimp is, that this is perfectly legal to do without asking permission from the gimp authors.

The license does not put any restrictions on the use of gimp, please feel free to do whatever you like.

Plus it gives us gimp authors a boost when we discover Gimp on television or in movies :)

GIMP isn't a registered trademark.

What they said, plus: The same applies to any software released under the GPL or similar license, from a command line program to a whole operating system in action. The more Free Software we see on screen in TV and movies, the happier the makers & users of these tools will be.

Whether this trademark would create a liability for a movie or TV production company that shows Audacity in use on screen is another question. I would say "definitely not" because a movie or TV program could not reasonably be mistaken for a computer program for editing sound files, nor could its appearance in use on screen be mistaken for a claim that the production company is the sole bona fide manufacturer the said computer program. IP attorneys and insurance providers might say otherwise, on the basis that it may be cost effective for movie or TV producers to pay extortionists up front rather than risk having to defend their rights in Court.

USPTO ( http://tess2.uspto.gov/ ) says an attempt to trademark "GIMP" was made years ago by a person selling legitimate products and services related to the GIMP, based on then-present use of the mark in commerce, but the application was abandoned.

For GIMP, no, it's not an issue.

There can also be moral rights associated with a creative work - for example, someone could write a free/lire program but say it could not be used to promote child pornography or the Roman Catholic church, independently of any copyright.

However, again, I doubt that's an issue for GIMP.
